End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity, referred to herein as "You" or "Licensee") and Free Colors, Ltd. ("Licensor") for the use of JoyToKey (the "Software").
By downloading, installing, or using the Software, You agree to be bound by the terms of this Agreement. If You do not agree to the terms of this Agreement, do not download, install, or use the Software.
1. Grant of License
Licensor grants You a non-exclusive, non-transferable license to use the Software.
- Personal Use: If You are using the Software for personal, non-commercial purposes, You may install and use the Software on multiple devices.
- Commercial Use: If You are using the Software for commercial purposes, You must obtain a separate license for each device on which the Software is installed. Commercial use includes, but is not limited to, any use of the Software for profit, business purposes, or in connection with any commercial activity.
2. Restrictions
You may not:
- Modify, adapt, translate, or create derivative works based on the Software.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software.
- Rent, lease, lend, distribute, or sublicense the Software to any third party, except as expressly permitted in this Agreement.
- Use the Software for any purpose that is illegal or prohibited by this Agreement.
- Remove any copyright, trademark, or other proprietary notices from the Software.
3. Ownership
The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant You any ownership rights to the Software.
4. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YOU ASSUME ALL RISKS ASSOCIATED WITH THE USE OF THE SOFTWARE.
LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OPERATE ERROR-FREE, OR BE FREE FROM INTERRUPTIONS OR OTHER DEFECTS.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. Termination
This Agreement is effective until terminated. Licensor may terminate this Agreement at any time without notice if You violate any terms of this Agreement. Upon termination, You must cease all use of the Software and delete all copies in Your possession.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.
8. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
9. Entire Agreement
This Agreement constitutes the entire agreement between You and Licensor with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, and understandings, whether oral or written.

By installing, copying, or otherwise using the Software, You acknowledge that You have read, understood, and agree to be bound by the terms of this Agreement.
